Terms of Service

This page is a draft, not yet finalized.
It's written specifically for how FirstPower and this website actually operate, not a generic template. But it hasn't yet been reviewed and accepted by gym staff or a lawyer. Don't rely on it as final until that review is complete.
1. Agreement to these terms
These Terms govern your use of firstpower-crossfit.com and your membership at FirstPower CrossFit. By creating an account, booking a class, purchasing a membership, or registering as an athlete or spectator for a FirstPower event, you agree to these Terms.
2. Who may use FirstPower
You must be at least 18 years old to create an account and hold your own membership.
CrossFit Teens and anyone under 18: an account for a person under 18 must be created and controlled by a parent or legal guardian, who accepts these Terms (including Section 6) on that minor's behalf and is responsible for their participation.
3. Your account
You're responsible for the accuracy of the information on your account and for keeping your password confidential. One account per person. Ten wrong password attempts in a row locks an account for 15 minutes as a security measure, not a penalty: it's automatic protection against someone else trying to guess your password. We may suspend or terminate an account for a violation of these Terms, abuse of other members or staff, or a safety concern at the gym.
4. Memberships, pricing and payment
Current plans and prices are shown on the Membership page, not reproduced here. Two kinds of plan exist:
- Fixed-term (e.g. 1/3/6/12 months): a one-time payment grants access for that term. It does not auto-renew and your card is not charged again automatically; access simply ends at the end of the term unless you buy another one.
- Drop-in / punchcard: a one-time payment grants a set number of classes, with no time limit on using them.
Payment is processed by Paystack. You enter your card or mobile money details on Paystack's own payment page. FirstPower's servers never receive or store your card number, CVV, or M-Pesa details. Your membership activates once Paystack confirms the payment succeeded.
Freezing: some plans allow pausing a membership for a limited period; the exact policy (and whether a plan is eligible at all) is shown on that specific plan. Plans that don't mention freezing aren't eligible.
5. Cancellations and refunds
You can cancel an active membership at any time from your account, or by asking staff. Cancelling stops future access under that membership. It does not reverse a payment already made. There is no automatic refund for unused time on a cancelled membership. FirstPower may make an exception at its discretion (for example, a documented medical reason), handled case by case.
6. Assumption of risk (please read this section carefully)
CrossFit and the other classes offered at FirstPower (Hyrox, Olympic lifting, strength training, mobility work, and similar) are high-intensity physical activities. They involve lifting weight, fast and repeated movement, and physical exertion, and they carry a real, inherent risk of injury (including, in rare cases, serious injury) even when performed correctly and under a coach's supervision.
By participating in any class, session, or FirstPower event, you confirm that:
- You are voluntarily participating and are physically able to do so. If you have a medical condition, injury, or concern that might affect your ability to train safely, you'll tell your coach before the session and consult a doctor first if there's any doubt.
- Every class is coached, and a coach scales the weights and movements to your level. A coach's presence reduces risk; it does not eliminate it, and you're responsible for telling your coach your actual limits and for stopping if something doesn't feel right.
- To the fullest extent permitted under the laws of Kenya, you release FirstPower, its coaches, staff, and owners from liability for injury, loss, or damage arising from your voluntary participation in training, except where that injury, loss, or damage results from FirstPower's gross negligence or willful misconduct, which this release does not and cannot cover.
7. Class bookings
Booking a class reserves you a spot, subject to capacity. If a class is full, you can join the waitlist and will be moved into the class automatically if a spot opens up. Please cancel a booking you can't make as soon as you know, so the spot can go to someone on the waitlist.
8. Code of conduct
- Follow your coach's instructions, especially around form and safe lifting technique.
- Rack weights, wipe down equipment, and treat the space and other members' time with respect.
- Abusive, threatening, or discriminatory behavior toward staff or other members is grounds for suspension or termination of membership, with no refund for remaining term.
9. Competitions and events (e.g. Fittest in Nairobi)
Athlete registration for FirstPower competitions currently happens off-platform, not through a website account. You don't need a firstpower-crossfit.com account to compete or to watch. If you register or compete, your name, division, gender, home gym, and your scores for each event are displayed publicly: on the website's live leaderboard, on a results screen at the venue, and afterward as the event's final results.
10. Acceptable use of the website
Don't attempt to bypass rate limits or account lockouts, scrape the site at volume, or otherwise use the website in a way that degrades it for other members.
11. Intellectual property
The FirstPower name, logo, and the content on this site (copy, photos, the workout programming shown for competitions) belong to FirstPower or are used with permission. You may not reproduce or use them commercially without asking first.
12. No warranty, limitation of liability (the website itself)
Separately from Section 6, the website itself is provided "as is." We aim to keep bookings, the leaderboard, and payments working reliably, but we don't guarantee the site will be uninterrupted or error-free. To the extent permitted by Kenyan law, FirstPower's liability for any claim arising from your use of the website (as distinct from in-person training) is limited to the amount you actually paid FirstPower in the 12 months before the claim.
13. Changes to these terms
We may update these Terms as the gym or the website changes. The "Last reviewed" date at the top will change when we do. Continuing to use FirstPower after an update means you accept the new version.
14. Governing law
These Terms are governed by the laws of Kenya, and any dispute is subject to the jurisdiction of the courts of Nairobi.
